Privacy Policy.
What personal information we collect, how we use it, who we share it with, and your rights under the Australian Privacy Act 1988 and the Australian Privacy Principles.
1. Introduction
WA Mining Index (ABN: 15 374 944 529) ("we", "us", "our") is committed to protecting the privacy of visitors to waminingindex.com.au ("the Platform").
This Privacy Policy explains what personal information we collect, how we use it, who we share it with, and how we comply with the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
2. What Information We Collect
2.1 Information from Visitors
When you visit the Platform, we automatically collect standard server log data, including: IP address; browser type and version; operating system; referral URL; pages visited and time spent on each page; device information. This information is used for analytics, security, and to improve the Platform.
2.2 Information You Provide
If you contact us via our enquiry forms, request information about a service provider, or subscribe to communications, we may collect: your name; your email address; your company name (if provided); phone number (if provided); any message content you submit.
2.3 Information About Listed Businesses
The Platform includes a directory of businesses operating in the Western Australian mining sector, including mining operations and service providers (drilling, logistics, equipment, labour hire, geotechnical services, and similar). Listed business information may include: business name and ABN; region of operation; services offered or commodities mined; publicly available business contact channels (such as general business phone numbers, generic business email addresses, and website URLs); operational status, where publicly disclosed.
This information is sourced from public government databases (including MINEDEX), corporate registries, business websites, and other publicly available sources. The Platform is a B2B directory and is not designed to publish personal contact details of individual employees or executives.
3. How We Use Your Information
We use the information we collect for the following purposes:
- To provide and maintain the Platform.
- To respond to your enquiries.
- To forward your enquiry to a relevant service provider where you have explicitly submitted an enquiry intended for that provider.
- To send transactional communications (such as direct responses to your enquiry).
- To send marketing communications where you have opted in or where permitted by applicable law (you may opt out at any time).
- To improve the Platform's content, structure, and user experience.
- To comply with legal obligations.
- To detect and prevent fraud or abuse of the Platform.
4. Lead Forwarding and Verified Listings
If you submit an enquiry through a contact form intended for a specific service provider, we may forward your enquiry details (name, email, company, message) to that provider so they can respond to you directly.
Routed enquiries are a feature of the paid Verified Listing. We do not charge per lead, take a commission, or resell your enquiry data — this commercial arrangement is disclosed on the relevant page and in our Editorial Policy, and it does not affect how your enquiry is handled: your enquiry goes to the provider you selected, and to no one else.
You may withdraw from this lead forwarding at any time by contacting us.
5. Disclosure of Information
We do not sell your personal information.
We may share your information with:
- Service providers you contact through our enquiry forms — only the information you submit through that form.
- Third-party service providers who help us operate the Platform, including hosting providers, analytics providers, email delivery services, and (where applicable) payment processors. These third parties are bound by appropriate data processing arrangements and may only use the information to provide the contracted services to WA Mining Index.
- Government authorities where required by law, including in response to lawful requests by public authorities.
6. Cookies and Analytics
We use cookies and similar technologies as described in our Cookie Policy. This includes Google Analytics to understand how visitors use the Platform.
Separately from analytics, your browser stores a small record of how you first reached this site (the referring website and any campaign parameters in the link you followed). It stays on your device, is never shared with third parties or used for advertising, and is read only if you choose to submit one of our forms — so we can tell how enquiries find us. Clearing your browser storage removes it.
7. Data Security
We implement reasonable security measures to protect personal information, including SSL/TLS encryption for data in transit and access controls on stored data. While we use commercially acceptable means to protect your information, no method of transmission over the internet is 100% secure, and we cannot guarantee absolute security.
8. Data Retention
We retain personal information for as long as necessary to fulfill the purposes outlined in this Privacy Policy, unless a longer retention period is required by law:
- Enquiry form submissions: retained for up to 24 months after submission, unless a longer retention period is necessary to respond to the enquiry or for legitimate business purposes.
- Account information (if applicable): retained while your account is active, plus the period required by Australian tax and accounting laws (generally up to 7 years for billing records).
- Analytics data: retained according to the default settings of our analytics provider (typically up to 26 months for Google Analytics).
9. Your Privacy Rights
Under the Australian Privacy Act 1988, you have the right to:
- Access the personal information we hold about you.
- Correct inaccurate or outdated information.
- Request deletion of your personal information, subject to legal and business retention requirements.
- Opt out of marketing communications at any time.
To exercise these rights, please contact us via our Contact page. We will respond to verified requests within a reasonable timeframe (generally 30 days).
Business Listing Removal
If you are an authorized representative of a business listed in our directory and wish to correct information about your business or request removal of your business listing, please use our automated portal at waminingindex.com.au/opt-out or contact us directly. Verified requests will be actioned within 5 business days.
10. Notifiable Data Breaches
We comply with the Notifiable Data Breaches (NDB) scheme under the Australian Privacy Act 1988. In the event of a data breach likely to result in serious harm to any individual whose personal information is involved, we will promptly notify affected individuals and the Office of the Australian Information Commissioner (OAIC) as required by law.
11. International Data Transfers
Our Platform and some of our service providers (including hosting and analytics) may process and store data on servers located outside Australia, including the United States. We take reasonable steps to ensure that these providers handle data in a manner consistent with the Australian Privacy Principles.
By using the Platform, you consent to the transfer of your information to these jurisdictions.
12. Children's Privacy
The Platform is intended for adult B2B professionals. We do not knowingly collect personal information from anyone under the age of 18. If you believe a minor has submitted personal information to us, please contact us so we can delete it.
13. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. We will notify users of material changes by posting a notice on the Platform or, where applicable, by email. Your continued use of the Platform after such modifications constitutes acknowledgment of the updated Privacy Policy.
14. Complaints
If you believe we have breached the Australian Privacy Principles and wish to make a complaint, please contact us via our Contact page. We will investigate your complaint and respond within a reasonable timeframe (generally 30 days).
If you are not satisfied with our response, you have the right to lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au.
For any privacy-related questions or requests, please contact us via waminingindex.com.au/contact.
